The record of the debate in 1866 is illuminating. . . .

This exchange supports very strongly the conclusion that the Citizenship Clause was intended to mean the same as the Civil Rights Act of 1866—excluding children born in the United States to foreign nationals (that is, to resident aliens). . . .

A considerable body of scholarship supports the view that the Citizenship Clause does not compel birthright citizenship, and that the current practice could be corrected by legislation, pursuant to Congress’ power under Section 5 of the 14th Amendment and Article I, Section 8, Clause 4. Contrary to the assertions of some (including the editorial page of the Wall Street Journal and Ben Domenech, publisher of The Federalist), amending the 14th Amendment is not required. . . .

The U.S. Supreme Court has never ruled in favor of birthright citizenship for the children of illegal immigrants. The oft-cited United States v. Wong Kim Ark (1898) involved the offspring of a Chinese couple present in the United States legally. And the frequently cited language from Plyler v. Doe (1982)—a 5 to 4 decision written by the activist Justice William Brennan, hardly a strong authority—is dicta contained in a footnote!

“We don’t want to be in the media,” he said. “It’s hard times right now for us.” . . .

Adding insult to injury: several bystanders, instead of helping, took pictures of the bloodied officer as he was facedown on the concrete and posted the images on social media, where the officer was mocked. . . .

“Pistol whipped his ass to sleep,” one user wrote, employing the hashtag #FckDaPolice. Another mockingly offered the officer milk and cookies for his “nap time.”

PHYSICIAN, HEAL THYSELF: Immigration Could Get Push From Pope Francis.

Lawmakers and immigration activists expect the pontiff’s message will resonate beyond Capitol Hill and inspire members of Congress and their constituents. The pope’s U.S. schedule includes an address to Congress on Sept. 24 and a meeting two days later with immigrants and Hispanic families at Philadelphia’s Independence Mall.

“He’s been clear on our failure to respond appropriately to immigrants and refugees,” Rep. Jim McGovern, D-Mass., told CQ. “I don’t think anyone will have any doubt on where the church stands on immigration after the pope visits the United States.”

In 1993, greater New York took in 128,434 legal immigrants, or .877 of its area population. (Illegal immigrants would have swollen that number considerably.) Against that standard, Vatican City should not object to taking a similar percentage of its population, especially with its relatively lower population density. That works out to just 8.7 persons each year (not counting illegals).

Since none at all are accepted, one begins to see a bit of a credibility problem. Namely, why should the Catholic hierarchy ask the United States to do (i.e., accept huge numbers of immigrants and refugees) what its own little country will not?

Some 355,000 people total hold temporary protected status, with El Salvadorians making up more than half of those. The government regularly extends TPS for some nationalities, sometimes for decades. An estimated 270 Somalis have held their TPS designation continuously since 1991.

Somali TPS holders though are a drop in the bucket compared to the nearly 10,000 Somalis entering the US annually through the permanent Refugee Resettlement Program.

By the way, Al Jazerra also tells us that there are 10,000 Syrians in the US eligible for TPS and they are not rushing to make themselves known to the government.

We recently learned that in one eight-month period in 2014, more than 8,100 deportable aliens were released by sanctuary jurisdictions. Of those, three thousand were felons and 62 percent had a prior criminal record. Nineteen hundred were later rearrested a total of 4,300 times on 7,500 different offenses.

But this debate over sanctuary policies has brought attention to another horrifying result of the federal government’s refusal to enforce our immigration law: the failure to deport convicted illegal alien sex offenders.

Last month, the Boston Globe reported that U.S. Immigration and Customs Enforcement (ICE) released from custody a large number of illegal criminal aliens who had previously been convicted of sex crimes, without closely tracking their movements or forcing them to register in the state where they were released on the National Sex Offender Public Registry (NSOPR).

Against that, it will be argued that some recent case law has nonetheless drifted toward the idea; more important, judges will be asked to defer to the EEOC in its (new) expert opinion.

But it’s not easy to think of an agency to whose views federal courts nowadays give less deference than the EEOC.

A Haitian immigrant who was released from prison in January after serving a sentence for attempted murder is back in custody on a murder charge in the death of a Connecticut woman last month.

His crimes also included the illegal use of a gun during a 1996 deadly shooting, qualifying him for deportation to his native Haiti, the newspaper reported. ICE spokesman Shawn Neudauer told the newspaper federal privacy laws prohibit him from discussing Jacques’ case.

People for the Ethical Treatment of Animals has jumped into a Puerto Rico legislative battle that’s brewing — in which parents of obese children could be fined between $500 and $800 if their kids don’t lose weight — and kicked off a campaign to push the benefits of a vegan diet.

Their campaign?

To put up a billboard on a Puerto Rican highway that reads: “Feeding Kids Meat Is Child Abuse. Fight the Fight. Go Vegan,” PETA reported in an emailed statement.

This isn’t the first such case I have heard about — and animal rights groups such as PETA bear a degree of responsibility. In fact, some children have died from being forced onto a vegan diet.

PETA’s education efforts put animals over babies. The group often fails to warn believers that depriving their very young children of animal-supplied nutrients can cause substantial harm to health. . . .

I know of one case in which a baby died because her vegan mother’s breast milk contained too few nutrients. Veganism imposed on infant nutrition is dangerous.

DOG BITES MAN: New Documents Reveal DOJ, IRS, and FBI Plan to Seek Criminal Charges of Obama Opponents.

Judicial Watch today released new Department of Justice (DOJ) and Internal Revenue Service (IRS) documents that include an official “DOJ Recap” report detailing an October 2010 meeting between Lois Lerner, DOJ officials and the FBI to plan for the possible criminal prosecution of targeted nonprofit organizations for alleged illegal political activity.

The newly obtained records also reveal that the Obama DOJ wanted IRS employees who were going to testify to Congress to turn over documents to the DOJ before giving them to Congress. Records also detail how the Obama IRS gave the FBI 21 computer disks [PDF], containing 1.25 million pages of confidential IRS returns from 113,000 nonprofit social 501(c)(4) welfare groups – or nearly every 501(c)(4) in the United States – as part of its prosecution effort. According to a letter [PDF] from then-House Oversight Committee Chairman Darrell Issa (R-CA) to IRS Commissioner John Koskinen, “This revelation likely means that the IRS – including possibly Lois Lerner – violated federal tax law by transmitting this information to the Justice Department.”

INTERESTING: Is saturated fat associated with diabetes? It depends on which kind of saturated fat.

We pretend, without proof that all carbohydrates are equal. That all proteins are equal. That all fats are equal. That all saturated fats are equal. . . .

This interesting recent article in The Lancet, Diabetes and Endocrinology . . . considers the differing effects of even versus odd chain length in saturated fats. . . .

The European Prospective Investigation into Cancer and Nutrition Study (EPIC), a huge multi-national, long-term cohort study following 340,234 people in 8 European countries identified 12,403 new cases of type 2 diabetes.

Even chain length SFAs (14:0, 16:0, and 18:0) were positively associated with the incidence of type 2 diabetes. This means that high levels of even chain saturated fat in the blood are associated with higher chances of diabetes. This may be caused by dietary SFA intake, but equally likely by excessive carbohydrate intake. Excessive intake of carbs led to De Novo Lipogenesis in the liver (literally the making of new fat) which produces many even length saturated fats. So, it was the carbohydrates that were increasing even chain length SFAs.

What about the odd chain length? These are typically the dietary saturated fats – like dairy fats for example. “odd-chain SFAs (15:0 and 17:0)… were inversely associated with type 2 diabetes.” Full fat dairy contains large amounts of odd chain SFAs, and is consistently associated with protection against Type 2 Diabetes. . . .

Looking at the chart of what correlated to even versus odd chain fatty acids, it is striking that dairy raises even chain SFA slightly, but odd chain SFA a lot. Red meat also tends to raise even chain SFA slightly, but alcohol, potatoes, soft drinks and margarine are the biggest culprits here. They tend to raise Even-chain FA and lower Odd-chain FAs – the worst combination.

On May 8, a symposium on jihadism took place at the Foreign Policy Institute in Stockholm. During the symposium, the Swedish Security Service revealed that the recruitment of Swedish youths to violent jihadism threatens to overwhelm the security service.

“I’ve worked for the Security Service for 30 years and as a police officer for 35 years,” said Swedish Security Service chief Anders Thornberg, “and I’ve never seen anything as inherently forceful as this. The pressure on the Security Service is huge. The recruitment of more and more people cannot go on. Eventually we will not be able to handle it.”

On May 8, the public broadcaster Swedish Radio (Sveriges Radio) reported on a group of residents of Gullberg, a small village in western Sweden, who are trying to thwart government plans to construct a housing project for asylum seekers in a renovated school in their village. Sweden’s Immigration Service (Migrationsverket) is now buying old schools, hotels and other large buildings in the Swedish countryside at a record pace, and renovating them to accommodate asylum seekers. . . .

Some residents of Gullberg, who were apparently frustrated, sent an anonymous letter to politicians stating that they intended to stop the plans by setting up a pig farm nearby. It would, they wrote, have “only an electrical fence between the animals and the school. Probably an electrical fence covering the entire back of the school. About 200 meters. Probably an impossible situation for some religions. Above all, Muslims.”

“There is a potential for a backlash against the vast majority of law abiding citizens from Asian/Pakistani communities from other members of the community believing their children have been exploited.

“These factors, combined with an EDL [English Defence League] protest in Dudley in April and a General Election in May could notably increase community tension.

“Police will be criticised if it appears we have not safeguarded vulnerable children, investigated offences and prosecuted offenders.”

FRUCTOSE powers a vicious circle.

Prepared foods and soft drinks in particular, but even purportedly healthy fruit juices contain fructose as an artificial additive — often in high quantities. In recent decades fructose spread throughout the food market, due to a reputation as being less harmful than glucose. In contrast to glucose, fructose barely increases blood glucose levels and insulin secretion. This avoids frequently recurring insulin spikes after any glucose consumption, which are judged harmful. In addition, fructose is sweeter to the taste.

But there’s a downside: the liver converts fructose very efficiently into fat. People who consume too much high-fructose food can in time become overweight and develop high blood pressure, dyslipidaemia with fatty liver and insulin resistance — symptoms that doctors group together under the name metabolic syndrome. . . .

A new paper by Krek and his team member Peter Mirtschink describes a further, more troubling side effect of fructose. The researchers have discovered a previously unknown molecular mechanism that points to fructose as a key driver of uncontrolled growth of the heart muscle, a condition that can lead to fatal heart failure. Their study was recently published in Nature.

We argue that residential exposure to ethnic diversity reduces social trust. Previous within-country analyses of the relationship between contextual ethnic diversity and trust have been conducted at higher levels of aggregation, thus ignoring substantial variation in actual exposure to ethnic diversity.

In contrast, we analyze how ethnic diversity of the immediate micro-context—where interethnic exposure is inevitable—affects trust. We do this using Danish survey data linked with register-based data, which enables us to obtain precise measures of the ethnic diversity of each individual’s residential surroundings. We focus on contextual diversity within a radius of 80 meters of a given individual, but we also compare the effect in the micro-context to the impact of diversity in more aggregate contexts.

Our results show that ethnic diversity in the micro-context affects trust negatively, whereas the effect vanishes in larger contextual units. This supports the conjecture that interethnic exposure underlies the negative relationship between ethnic diversity in residential contexts and social trust.
